Terms of Service

Using the app

Day Marker is provided to help you track personal habits, streaks, and progress. You may use the App for personal, non-commercial purposes. The core App is free to use, with no account required. An optional paid tier, Pro, adds cloud sync, widgets, advanced analytics, custom themes, habit templates, and export/import, as described below.

Eligibility

You must be capable of forming a binding contract to use the App, and to purchase Pro. If you are under the age of majority where you live, you may only use the App, and only purchase Pro, with the involvement of a parent or legal guardian.

Accounts (Pro)

Creating a Pro account is optional and only required if you want cloud sync or the other Pro features. If you create an account, you agree to:

• Provide accurate information when signing up.
• Keep your login credentials confidential and secure.
• Notify us promptly if you suspect unauthorized access to your account.
• Use one account per person, for your own personal use.

You are responsible for all activity that happens under your account.

Subscriptions and in-app purchases

Pro is offered as a subscription or one-time in-app purchase, as described in the App and processed entirely through Apple's App Store or Google Play Billing, as applicable to your device. By purchasing Pro, you also agree to the applicable platform's payment terms.

• If Pro is offered as a subscription, it renews automatically at the end of each billing period unless you cancel before the renewal date, through your Apple ID or Google Play account settings.
• Prices for Pro may change from time to time; where required, we'll give you notice before a change takes effect on your next billing cycle.
• Refunds, billing disputes, and cancellations are handled directly by Apple or Google under their respective refund policies — iDevia does not process payments or issue refunds directly.
• Downgrading or cancelling Pro does not delete your local, free-tier data. Handling of your synced cloud data on downgrade is described in our Privacy Policy.

License

Subject to these terms, iDevia grants you a limited, non-exclusive, non-transferable license to install and use the App, including any Pro features you've purchased, for your own personal, non-commercial use. This license ends if you violate these terms or uninstall the App.

Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except where the law explicitly allows it.
• Attempt to access another user's Pro account or synced data without authorization.
• Use the App to store or transmit unlawful content.
• Interfere with or disrupt the App, our servers, or the sync service.
• Use automated means to create accounts or purchase Pro at scale.

Your data

On the free tier, all habit data you create is stored locally on your device, and you are responsible for your own device and any backups. If you use Pro with cloud sync enabled, a copy of that data is also stored in your account, as described in our Privacy Policy. You retain ownership of the habit data you create; we don't claim any rights to it beyond what's needed to provide the sync service you've opted into.

Intellectual property

The App, including its design, branding, and underlying code, is owned by iDevia and protected by applicable intellectual property laws. Nothing in these terms transfers any ownership of the App to you.

Third-party services

The App relies on third-party services — including Apple's App Store, Google Play Billing, and the infrastructure providers that power Pro cloud sync — to operate. Your use of those services is also subject to their own terms and policies, which we encourage you to review.

Termination

We may suspend or terminate your access to Pro if you violate these terms. You may stop using the App, or delete your Pro account, at any time; see our Privacy Policy for how to request account deletion.

No warranty

Day Marker is provided "as is," without warranties of any kind, express or implied. We do not guarantee that the App, including Pro features like cloud sync, will be uninterrupted, error-free, or suitable for any particular purpose. Habit tracking and streak information are provided for personal motivation only and are not medical, health, or professional advice.

Limitation of liability

To the fullest extent permitted by law, iDevia shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App, including loss of habit data stored on your device or in your Pro account.

Governing law

These terms are governed by the laws of India, without regard to conflict-of-law principles, except where local law requires otherwise.

Changes to the app or these terms

We may update Day Marker and these Terms of Service from time to time, including to introduce or change Pro features and pricing. Continued use of the App after an update constitutes acceptance of the revised terms.
